2-year-old boy, who was in good health before being placed back in his parents’ custody, died after they starved him to death; father sentenced

Michigan – In a heartbreaking case in Michigan, a 26-year-old father, identified as J. Cheek, has been sentenced to a lengthy prison term for the starvation death of his young son. Cheek will face 24 to 50 years behind bars for his role in the tragic demise of his 2-year-old child, a case that has captured the attention of the community.

Judge E. Servitto handed down the sentence on Wednesday, marking a significant moment in a deeply saddening case. Cheek had earlier reached a plea agreement with prosecutors in October, where he entered a no contest plea to charges of second-degree murder and second-degree child abuse. This plea agreement came as a resolution to avoid a potential life sentence, with prosecutors recommending a maximum sentence of fifty years as part of the deal.

In conjunction with the murder charge, Cheek was also sentenced to up to 10 years for child abuse, which will be served concurrently. This means he will serve both sentences at the same time, reflecting the gravity and interconnectedness of his actions leading to his son’s death. Notably, Cheek was credited with 643 days of time served, which will be deducted from his total sentence.

The tragic sequence of events leading to the young boy’s death began with a distressing 911 call made by Cheek and the child’s 28-year-old mother, identified as S. Zaitona, on March 16, 2023. They reported finding their son deceased in his crib. The subsequent investigation by the Office of the Medical Examiner revealed starvation as the cause of death, pointing to severe neglect by the parents.

During the judicial proceedings, it emerged that the toddler was previously in foster care and had been returned to his parents’ custody not long before his untimely death. The Assistant Prosecutor, M. Zappitell, highlighted this during the arraignment by stating, “The child was healthy in foster care, and once it got into the care of these two individuals, it met its demise.” This statement underscored the dramatic and fatal change in the child’s well-being after being placed back with his parents.

The case has not only led to Cheek’s sentencing but also casts a spotlight on the mother’s upcoming trial. Zaitona faces the same charges as Cheek, with her trial scheduled to begin on April 1, 2025. As the community grapples with the disturbing details of the case, there are also concerns about Zaitona’s potential flight risk, exacerbated by accusations that she gave birth to the child in Ohio specifically to evade the scrutiny of Child Protective Services (CPS).

Prosecutor P. Lucido commented on the case’s resolution, expressing both sorrow and a measure of judicial satisfaction: “This is a heartbreaking and profoundly sad case. A two-year-old child, full of potential and deserving of love and care, was failed in the most devastating way. No sentence can bring back this innocent life, but hopefully the family can begin to heal.”
