Mother, who was caught on video kicking her 3-year-old son while on the floor after she knocked the boy to the ground just because he insisted to play, will not spend time in jail

Florida – In a disturbing case out of Florida, a mother who was filmed abusing her toddler has been sentenced to three years of probation after a plea deal was reached with the prosecutors. The incident, which involved severe physical abuse, has sparked debates over the consequences for child abuse and the justice system’s handling of such cases.

The 30-year-old mother, identified as Y. Storozhuk, faced felony child abuse charges after her neighbor provided video evidence of the shocking abuse that took place in October 2023. The footage showed Storozhuk aggressively handling her then-3-year-old son—lifting him off the ground, throwing him down, and kicking him repeatedly. According to police reports, Storozhuk was also captured on a second camera pushing her son so hard that he fell back and hit the floor. The disturbing incident did not end there; the mother was seen kicking the child repeatedly as he tried to get up.

The arrest affidavit detailed the violent nature of the abuse: “While the victim is on the ground, defendant maliciously kicks the victim twice. Defendant then grabs the victim by the face and pushes him to the ground as the victim is attempting to get up. Defendant repeatedly kicks the victim while exiting the camera view.” When confronted with the footage during a post-Miranda recorded interview, Storozhuk admitted to the abuse. She explained that her actions were a form of punishment because her son insisted on going to the playground, describing him as “difficult and uncooperative.”

Despite the severity of the actions, the legal proceedings culminated in a plea agreement that allowed Storozhuk to avoid jail time. She was sentenced to three years of probation and now bears the status of a convicted felon. The court also mandated that Storozhuk undergo a mental health evaluation and attend a parenting class as conditions of her probation. During the sentencing, Judge C. Cabarga sternly warned Storozhuk about the consequences of any future misconduct: “If you lay a finger on this child, you’re coming back before me. And the minimum, the maximum I can sentence you to, is 10 years, the minimum I will sentence you to is 22.5 months in state prison. For a finger.”

The defense argued that Storozhuk was under extreme pressure at the time of the incident, a factor that the court took into consideration. Her attorney stated, “She was under an extreme amount of pressure when this happened. Again, we’re not condoning what she did. She knows. She’s accepted responsibility, but at least now she can move on and not go to prison.”

Despite the defense’s arguments and the court’s decision, the plea deal has been met with criticism, particularly from the child’s dependency attorney, who opposed the agreement, advocating for a stricter penalty. The case has highlighted significant issues within the justice system regarding child abuse, with many questioning whether the sentence was sufficient given the gravity of the abuse. The child, deeply affected by the trauma, is currently living with a foster family while the dependency case regarding his custody continues in family court.
